These Terms of Service ("Terms") are an agreement between you and REPLACE_WITH_LEGAL_ENTITY ("HARK," "we," "us," "our") governing your use of the HARK iOS application, the harktime.com website, and the related services (collectively, the "Service").
By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. What HARK is
HARK is a contemplative listening-prayer companion. It is a tool, not a substitute for prayer, community, mental-health care, or pastoral care. The AI features in HARK never claim to speak for God; they synthesize only the content you captured in your own session.
HARK is not a medical, psychiatric, or crisis service. If you or someone you know is in immediate danger, please reach out to local emergency services or call 988 (in the US) for the Suicide and Crisis Lifeline. Crisis resources are available in the app at Profile → Crisis Help.
2. Eligibility
You must be at least 13 years old to use HARK.
3. Your account
You are responsible for keeping your password secure, all activity under your account, and notifying us promptly if you suspect unauthorized use. You may delete your account at any time per the Privacy Policy.
4. Acceptable use
You agree not to:
- Share unlawful, harmful, threatening, abusive, harassing, defamatory, or privacy-invading content
- Promote violence, discrimination, or hatred
- Impersonate others
- Attempt unauthorized access to accounts or systems
- Reverse engineer the Service
- Use bots or scrapers without our permission
- Resell or sublicense the Service without our permission
- Spam, harvest contacts, or send unsolicited communications
- Upload malicious code
- Violate applicable law
We may remove content or suspend accounts for violations.
5. User-generated content
You retain ownership of what you write. By publishing to Community or sharing to Circle, you grant us a worldwide, non-exclusive, royalty-free license to host, display, and distribute your content only as necessary to provide the Service to you and the people you've chosen to share with. You confirm you have the right to share what you're sharing.
We do not claim ownership of your content. We do not use your content to train any AI model.
6. AI-generated content
HARK's AI features generate reflections based only on what you captured. They are not a substitute for spiritual direction, theological teaching, or pastoral counsel, and should not be interpreted as God speaking through the Service. AI content is provided "as-is."
7. Subscriptions
HARK is free to use. HARK Pro is an optional auto-renewing subscription processed by Apple through the App Store.
- HARK does not collect or store your payment information.
- Subscriptions auto-renew unless canceled at least 24 hours before the renewal date.
- Manage subscriptions in your Apple ID settings: Settings → [Your Name] → Subscriptions.
- Refunds are handled by Apple.
The annual plan offers a 3-day free trial. To avoid being charged, cancel at least 24 hours before the trial ends.
If we change subscription prices, we will give you at least 30 days notice. You can cancel before the new price takes effect.
8. Intellectual property
The Service — including its software, design, content, branding, and the HARK and hark. and heard. marks — is owned by HARK and protected by copyright, trademark, and other IP laws. We grant you a limited, non-exclusive, non-transferable, revocable license for personal, non-commercial use.
The Foundations curriculum is © HARK. You may not reproduce, distribute, or create derivative works without written permission.
9. Privacy
Our Privacy Policy at harktime.com/privacy explains data practices.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access for Terms violations, legal requirements, or liability concerns, with reasonable notice unless the violation is severe or repeated.
11. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND. HARK IS NOT A MEDICAL, PSYCHIATRIC, COUNSELING, OR CRISIS SERVICE. THE AI FEATURES DO NOT SPEAK FOR GOD. THE FOUNDATIONS CURRICULUM IS NOT INDIVIDUAL PASTORAL COUNSEL. NOTHING IN THE SERVICE SHOULD BE RELIED UPON AS A SUBSTITUTE FOR PROFESSIONAL ADVICE OR HUMAN COMMUNITY.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS RELATED TO THE SERVICE WILL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM, OR $100, WHICHEVER IS GREATER.
13. Governing law and dispute resolution
These Terms are governed by the laws of the State of REPLACE_WITH_STATE. Disputes will be resolved by binding arbitration administered by the AAA under its Consumer Arbitration Rules, except for small-claims-eligible matters.
YOU AND HARK AGREE TO BRING CLAIMS ONLY IN INDIVIDUAL CAPACITY, NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE ACTION.
You may opt out of binding arbitration within 30 days of first agreeing to these Terms by emailing support@harktime.com with "ARBITRATION OPT OUT" in the subject line.
14. Changes to these Terms
Material changes will be posted at harktime.com/terms with at least 30 days notice. Continuing to use the Service after the effective date constitutes acceptance.
