02What HARK is — and what HARK is not
HARK is a faith-based listening-prayer companion designed to help users make space for stillness, reflection, journaling, discernment, and faithful action.
HARK is not:
- A church, denomination, ministry authority, pastor, priest, spiritual director, therapist, counselor, doctor, attorney, financial advisor, or emergency service
- A substitute for Scripture, prayer, pastoral care, professional counseling, medical care, legal advice, financial advice, or trusted human community
- A crisis response, suicide prevention, abuse reporting, emergency, psychiatric, medical, or mental-health service
- A guarantee that a user has heard from God or that any impression, reflection, action item, or AI-generated output is spiritually correct
If you or someone else is in immediate danger, call local emergency services. In the United States, you may call or text 988 for the Suicide & Crisis Lifeline. HARK cannot monitor, respond to, or intervene in emergencies.
03AI features do not speak for God
HARK may provide AI-generated reflections, summaries, session letters, prompts, action items, themes, encouragement, or carry cards. AI output is generated by software based on the content you submit and related context you provide.
You understand and agree that AI output:
- Does not speak for God
- Does not reveal God's will
- Does not replace Scripture, prayer, discernment, pastoral counsel, or wise community
- May be inaccurate, incomplete, inappropriate, biased, repetitive, generic, or spiritually unhelpful
- Is provided for reflection and organizational support only
- Should not be relied upon for medical, mental-health, legal, financial, relational, safety, or major life decisions
You are responsible for using your own judgment and seeking appropriate professional, pastoral, or emergency support when needed.
04Eligibility
HARK is intended for adults. You must be at least 18 years old to create an account, purchase a subscription, post to Community, join or create a Circle, submit content to AI, or use sharing features.
If HARK later allows users under 18, they may use the Service only with parent or guardian consent and under additional safeguards. HARK is not directed to children under 13. You may not use the Service if you are under 13.
By using the Service, you represent that you meet the eligibility requirements and that your use of the Service is lawful in your jurisdiction.
HARK is operated from the United States by a Virginia limited liability company. The Service may be available worldwide, but these Terms are drafted for a U.S.-based operator and may be supplemented or limited by mandatory laws in your country of residence.
05Accounts and security
You may need an account for certain features, including sync, Circle, Community, subscriptions, or account-based preferences.
You agree to:
- Provide accurate account information
- Keep your login credentials secure
- Not share your account with others
- Notify us promptly of unauthorized access or suspected security issues
- Be responsible for all activity under your account
We may refuse, suspend, restrict, or terminate accounts for violations of these Terms, suspected abuse, legal risk, security concerns, or misuse.
If the Service supports account creation, we will provide a way to initiate account deletion within the app. Deleting your HARK account does not automatically cancel Apple App Store or Google Play Store subscriptions; you must manage cancellation through the applicable app-store account settings unless the app store provides another mechanism.
06License to use HARK
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Service for your own lawful, personal, non-commercial use.
You may not use the Service for commercial, organizational, ministry, training, coaching, counseling, therapeutic, or group-program purposes without our written permission or a separate agreement.
07Acceptable use
You agree not to:
- Violate any law, regulation, or third-party right
- Harass, threaten, abuse, exploit, shame, intimidate, bully, stalk, or harm another person
- Post or share defamatory, hateful, violent, discriminatory, sexually explicit, exploitative, obscene, deceptive, fraudulent, or unlawful content
- Share content that encourages self-harm, suicide, eating disorders, abuse, violence, criminal activity, or reckless behavior
- Share inflammatory religious commentary, inaccurate or misleading quotations of religious texts, or content intended to humiliate, intimidate, or harm people based on religion or other protected characteristics
- Impersonate another person, ministry, church, brand, organization, or public figure
- Upload malware, viruses, harmful code, or security exploits
- Scrape, crawl, harvest, copy, index, or use automated tools without our written permission
- Reverse engineer, decompile, disassemble, modify, or create derivative works from the Service
- Circumvent subscriptions, paywalls, security measures, rate limits, access controls, or usage restrictions
- Use HARK, its prompts, AI outputs, designs, copy, frameworks, curriculum, or branding to build, train, benchmark, or improve a competing product or service
- Use the Service for surveillance, profiling, targeted advertising, data brokerage, or unauthorized data collection
- Misrepresent HARK outputs as divine revelation, professional advice, medical guidance, counseling, or pastoral authority
- Interfere with or disrupt the Service or our vendors' systems
We may remove content, restrict features, suspend accounts, or report matters to appropriate authorities where we believe it is necessary.
08Community, Circle, and user-generated content
HARK may offer Community, Circle, prayer room, testimony, wins, confirmations, comments, reactions, sharing, or other user-generated content features.
You own your content
You retain ownership of content you create and submit, subject to the license you grant below.
License you grant HARK
When you post, upload, submit, publish, or share content through the Service, you grant HARK and Edgery - Mission Evangelists, PS a worldwide, non-exclusive, royalty-free, transferable, sublicensable license to host, store, reproduce, display, format, adapt, moderate, remove, preserve, transmit, distribute, and otherwise use that content as needed to:
- Operate, provide, secure, moderate, and improve the Service
- Display the content to the audience you selected
- Enforce these Terms and Community Guidelines
- Comply with law and legal process
- Protect HARK, Edgery - Mission Evangelists, PS, users, vendors, partners, and the public
For private session content that remains local and is not submitted to an online feature, this license does not apply because HARK does not receive that content.
User responsibility
You represent and warrant that:
- You own or have rights to share your content
- Your content does not violate law, privacy rights, publicity rights, copyright, trademark, contract rights, confidentiality obligations, or any other rights
- Your content complies with these Terms
Visibility and anonymity
Do not share anything you would not want seen, copied, screenshotted, preserved, or redistributed by others. Circle and Community features are not confidential counseling or pastoral relationships.
Anonymous posting may hide your display name from other users, but it does not guarantee legal, technical, or operational anonymity from HARK, vendors, moderators, or lawful requests.
Moderation and enforcement
We may, but are not obligated to, review, filter, moderate, remove, preserve, restrict, or refuse content. We may provide reporting, blocking, post-deletion, account-safety, and user-safety tools, including the ability to report posts or users, block users, delete your own posts where supported, and contact HARK about moderation concerns at support@harktime.com.
We do not guarantee that all objectionable content will be removed immediately or that moderation will prevent all harm.
No endorsement
User content reflects the views of the user who posted it, not HARK or Edgery - Mission Evangelists, PS. We do not endorse user content.
09Prayer requests, testimonies, and sensitive disclosures
HARK may invite personal reflection. You should not submit or share highly sensitive information unless you are comfortable with how the applicable feature works.
Do not use HARK to report emergencies, abuse, imminent self-harm, threats of violence, medical crises, or other urgent matters. Use emergency services, crisis resources, trusted leaders, or appropriate authorities.
We may take action if we become aware of content suggesting imminent harm, abuse, exploitation, threats, or illegal activity, but we do not promise to monitor all content or provide intervention.
10Subscriptions, purchases, trials, and refunds
HARK may offer free and paid features. Paid features may include the subscription tier currently called HARK Pro.
App-store billing
For iOS purchases, subscriptions are processed by Apple through the App Store. For Android purchases, subscriptions are processed by Google through the Google Play Store. HARK does not collect or store your full payment card information for app-store purchases.
Before you subscribe, the applicable purchase screen should clearly display the subscription title, features, price, billing period, renewal terms, free-trial terms where applicable, and links to these Terms and the Privacy Policy.
HARK Pro prices, billing periods, free-trial terms, renewal details, taxes, currencies, and promotional offers may vary by country, platform, app store, and offer. The terms shown at purchase control the price and billing period for that purchase.
Auto-renewal
Subscriptions automatically renew at the end of each billing period unless canceled before renewal under the applicable app-store rules. App stores commonly require cancellation at least 24 hours before the end of the current period, but the exact cancellation timing is governed by the Apple App Store or Google Play Store terms that apply to your purchase.
You can manage or cancel subscriptions through your Apple account settings or Google Play account settings, as applicable. Deleting the HARK app or deleting your HARK account does not automatically cancel your subscription.
Trials and promotions
Free trials, promotional pricing, introductory offers, and discounts may be offered at our discretion and may be subject to additional terms. After a trial ends, your subscription may automatically renew at the then-current price unless canceled in time through the applicable app store.
Refunds
Apple and Google handle refunds for app-store purchases under their respective policies. We cannot guarantee refunds and may not have authority to issue refunds directly for Apple-processed or Google-processed purchases.
Web or non-app-store purchases
If HARK later offers web, partner, enterprise, ministry, group, or other non-app-store purchases, those purchases may be processed by Stripe or another payment provider and may be subject to additional payment terms presented at purchase.
Feature changes
We may add, change, limit, or discontinue free or paid features. If required by law or platform rules, we will provide notice of material changes.
11Intellectual property and brand protection
The Service, including HARK's software, source code, design, user interface, icons, logos, names, marks, audio experiences, copy, prompts, frameworks, session flows, curriculum, lessons, foundations content, listening-prayer structure, community structure, AI prompt architecture, product concepts, graphics, images, trade dress, and all related intellectual property, is owned by Edgery - Mission Evangelists, PS, HARK, or our licensors.
This includes, without limitation, the names and marks HARK, hark., heard., HARK Circle, The HARK Method, Listen · Reflect · Live Faithfully, Prepare · Listen · Discern · Act, Listen and Advance Framework, the HARK logo, HARK sound/waveform marks, app icon, notification sounds, original music, voice-guided audio, Foundations curriculum, session arc language, discernment framework, carry cards, AI letter format, and other HARK-branded materials.
Except for the limited license granted to you, no rights are transferred. You may not copy, reproduce, distribute, display, sell, license, modify, create derivative works from, or exploit HARK intellectual property without written permission.
You may not register, use, or attempt to use any confusingly similar names, domains, social media handles, marks, logos, products, apps, or services.
12Feedback
If you submit ideas, suggestions, improvements, feature requests, bug reports, testimonials, names, slogans, creative concepts, or other feedback, you grant HARK and Edgery - Mission Evangelists, PS a perpetual, worldwide, irrevocable, royalty-free license to use, modify, commercialize, and incorporate that feedback without compensation or obligation to you.
Do not submit confidential ideas unless we have a separate written agreement.
13Third-party content, scripture, music, and services
The Service may include or link to third-party content, open-source or public-domain scripture sources, music, ambient audio, AI providers, app stores, hosting providers, analytics tools, authentication providers, payment processors, and other services.
Third-party materials remain owned by their respective owners and may be subject to separate terms and licenses. HARK does not guarantee third-party availability, accuracy, security, theological alignment, translation accuracy, or fitness for your purpose.
HARK may include original music, app sounds, audio experiences, and voice recordings created by HARK, Dominique Cooper, Edgery - Mission Evangelists, PS, contractors, licensors, or future partners. Those materials are part of the Service and may not be copied, extracted, downloaded, distributed, performed, resold, reused, trained on, sampled, remixed, or used outside the Service unless expressly allowed by HARK in writing or by the applicable license.
If HARK includes scripture translations, devotional excerpts, music, audio, or other licensed content, those materials may not be copied, extracted, downloaded, distributed, performed, resold, reused, or used outside the Service unless expressly allowed by the applicable license.
14App Store and platform-specific provisions
Apple-specific provisions
If you download HARK from Apple's App Store, you acknowledge and agree that:
- These Terms are between you and HARK, not Apple.
- Apple is not responsible for the Service or its content.
- Apple has no obligation to provide maintenance or support for the Service.
- Apple is not responsible for claims relating to the Service, including product liability, legal compliance, consumer protection, intellectual property, or user claims.
- Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce these Terms against you as related to Apple-distributed versions of the app.
- Your use of the app must comply with the App Store rules and any applicable Apple terms.
Google Play-specific provisions
If you download HARK from Google Play, you acknowledge and agree that:
- These Terms are between you and HARK, not Google.
- Google is not responsible for the Service or its content.
- Your use of the app must comply with Google Play rules and any applicable Google Play terms.
- Google Play purchases, subscriptions, cancellations, and refunds are governed by Google Play policies in addition to these Terms.
15Beta features and availability
Some features may be experimental, in beta, incomplete, unavailable, or changed without notice. Beta features may contain bugs, interruptions, errors, or data-loss risks. HARK is not responsible for losses caused by reliance on beta, experimental, or unreleased features.
We do not guarantee that the Service will always be available, uninterrupted, secure, error-free, or compatible with all devices, operating systems, app stores, regions, or future platform changes.
16Privacy
Our Privacy Policy explains how we collect, use, disclose, and protect information. By using the Service, you agree to the Privacy Policy.
17Account termination
You may stop using HARK at any time. You may delete your account where supported.
We may suspend, restrict, terminate, or delete your account or access to the Service if we believe:
- You violated these Terms or other policies
- Your content or conduct creates risk or liability
- Your use threatens security, safety, or integrity
- We are required to do so by law or platform rules
- Continued access is no longer commercially, technically, legally, or operationally feasible
Termination does not limit any rights or remedies available to us. Sections that by their nature should survive termination will survive, including intellectual property, feedback, disclaimers, liability limits, indemnity, dispute resolution, and payment obligations.
18Copyright and DMCA policy
We respect intellectual property rights. If you believe content on HARK infringes your copyright, send a notice to our designated copyright agent:

We may remove or disable access to content alleged to infringe and may terminate repeat infringers. If HARK supports user-generated content, Edgery - Mission Evangelists, PS intends to designate and maintain a DMCA agent with the U.S. Copyright Office where required and publish current agent information.
19Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, SECURITY, OR ERROR-FREE OPERATION.
WE DO NOT WARRANT THAT:
- THE SERVICE WILL MEET YOUR NEEDS OR EXPECTATIONS
- AI OUTPUT WILL BE ACCURATE, APPROPRIATE, THEOLOGICALLY SOUND, OR SPIRITUALLY HELPFUL
- THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE
- CONTENT WILL BE PRESERVED, BACKED UP, OR RECOVERABLE
- COMMUNITY OR CIRCLE FEATURES WILL BE FREE FROM OBJECTIONABLE CONTENT OR MISUSE
- ANY IMPRESSION, REFLECTION, PROMPT, ACTION ITEM, OR OUTPUT REPRESENTS GOD'S VOICE, WILL, OR DIRECTION
HARK IS NOT RESPONSIBLE FOR DECISIONS YOU MAKE, ACTIONS YOU TAKE, OR ACTIONS YOU DO NOT TAKE BASED ON THE SERVICE.
20Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARK, STYLE DIGITAL LLC, AND THEIR OWNERS, OFFICERS, DIRECTORS, MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AGENTS, AFFILIATES, LICENSORS, VENDORS, AND PARTNERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, LOSS OF GOODWILL, PERSONAL INJURY, EMOTIONAL DISTRESS, SPIRITUAL DISTRESS, BUSINESS INTERRUPTION, OR OTHER INTANGIBLE LOSSES ARISING FROM OR RELATED TO THE SERVICE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO HARK THROUGH THE SERVICE IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR (B) $100.
Some jurisdictions do not allow certain disclaimers or limitations, so some of the above may not apply to you.
21Indemnification
To the maximum extent permitted by law, you agree to defend, indemnify, and hold harmless HARK, Edgery - Mission Evangelists, PS, and their owners, officers, directors, members, managers, employees, contractors, agents, affiliates, licensors, vendors, and partners from and against claims, liabilities, damages, losses, costs, and expenses, including reasonable attorneys' fees, arising from or related to:
- Your use or misuse of the Service
- Your content
- Your violation of these Terms
- Your violation of law or third-party rights
- Your reliance on AI output or user-generated content
- Your interactions with other users
22Governing law
These Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law principles.
23Dispute resolution, arbitration, and class-action waiver
Please review this section carefully. It affects your legal rights.
Informal resolution first
Before filing a claim, you agree to first contact us at support@harktime.com with a written description of the dispute, your contact information, the relief requested, and enough information for us to evaluate the claim. You and HARK agree to attempt in good faith to resolve the dispute informally for at least 60 days.
Binding arbitration
If a dispute is not resolved informally, either party may elect to resolve the dispute by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except where prohibited by law or where small-claims court is available.
Small claims
Either party may bring an individual claim in small-claims court if the claim qualifies.
Class-action waiver
You and HARK agree that each may bring claims only in an individual capacity and not as a plaintiff, class member, representative, or participant in any class, collective, consolidated, private attorney general, or representative proceeding, except where this waiver is prohibited by law.
Mass arbitration procedures
If 25 or more similar arbitration demands are filed by or with the assistance of the same or coordinated counsel or organizations, the parties agree to use the applicable AAA mass-arbitration procedures or another fair batching procedure approved by the arbitrator or administrator.
Opt out
You may opt out of arbitration within 30 days after first accepting these Terms by emailing support@harktime.com with the subject line "ARBITRATION OPT OUT" and including the email address associated with your HARK account.
24Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms in the app and/or on our website with a new "Last Updated" date. If changes are material, we will provide notice as required by law. Your continued use of the Service after changes take effect means you accept the updated Terms.
25Miscellaneous
- Entire agreement: These Terms and the Privacy Policy are the entire agreement between you and HARK regarding the Service.
- Severability: If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
- No waiver: Our failure to enforce a provision is not a waiver.
- Assignment: You may not assign these Terms without our written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, or by operation of law.
- No third-party beneficiaries: Except for Apple where applicable, these Terms do not create rights for third parties.
- Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
- Headings: Headings are for convenience only.
